BEAD Restructuring Policy Notice 

Per the BEAD Restructuring Policy Notice published by the National Telecommunications and Information Administration (NTIA) on June 6, 2025, NDIT has reviewed the FCC’s National Broadband Map to assess whether an ULFW provider (technology code 70) currently offers service that meets the requirements set forth in Appendix A of the Notice to any BEAD-eligible BSLs in its jurisdiction. It has been determined that multiple ULFW providers offer service to BEAD-Eligible BSLs in North Dakota.

By this notice, ULFW providers are hereby notified that they have seven (7) calendar days to respond that the ULFW provider intends to submit evidence that BEAD funding is not required for the locations it serves. Such notice must be received by NDIT no later than 5:00pm CST on June 24th, 2025. If no intent notices are received, the submission period will conclude. Only BSLs contained in the Eligible Locations file below will be considered.

If an intent to submit has been received, the provider shall be allowed an additional seven (7) calendar days to submit documentation supporting the claim that the existing ULFW services meet the same technical and service standards required for a ULFW application for a BEAD subgrant (see Appendix A of the Notice) and the provider is reasonably capable of delivering the service for at least four years after the date of Final Proposal submission. Evidence must be submitted no later than seven (7) days after the notice of intent period concludes. (i.e., July 1st, 2025)

If a ULFW service provider demonstrates that it meets the requirements specified by this Policy Notice, the served locations will be ineligible for BEAD Program funding. If the provider does not respond or fails to meet the requirements specified by the Policy Notice, the locations in question will remain BEAD eligible.

All submissions must be sent to broadband@nd.gov with the subject line “ULFW Challenge - [provider name]” i.e., (ULFW Challenge – ISP 123).
The email should contain the organization name and primary point(s) of contact information. Attached to the emails should be a list of locations the ULFW provider intends to submit evidence for.
